Minutes December 9, 2013

The Enterprise City Council met in regular session on Monday , December 9, 2013 at 7:30 p.m. Those present were Mayor Margie Shaw; Councilors Tim Parks, Laura Miller, Stacey Karvoski, Jenni Word, Bill Coffin; City Attorney Roland Johnson; Staff Denine Rautenstrauch, Wes Kilgore, Ronnie Neil, Michele Young.

CONSENT AGENDA

Councilor Miller made and Councilor Parks seconded the motion to approve the November 11, 2013 minutes. Motion passed unanimously.

PUBLIC COMMENT

Mayor Shaw read a letter from Sondra Lozier thanking the City Council for the $10 gift certificates used on the Holiday Bus and the gift drawing from the Mayor, two participants were very pleased.

UNFINISHED BUSINESS

MUNICIPAL COURT: Councilor Karvoski stated that they are recommending that the City disband Municipal Court effective January 1, 2014 and that the Court is closed out by June 30, 2014. Chief Kilgore felt the Council would be giving up control. Councilor Karvoski stated that Paige's recommendation was that we move to a Hearings Officer. That is what the committee would recommend. Roland concurred with Wes, that we would lose control if we turn it over to Circuit Court. The civil penalty is where we do have control and is a means to have enforcement. Roland is reluctant in doing this until we get the ordinance changes in place. Councilor Karvoski stated that our officers would immediately start citing to District court and that would give the city 6 months to get the ordinance changes in place. Councilor Karvoski stated their thought is that any type of tickets immediately go to circuit court, ordinance offenses would go to our court

Roland gave some history to the council regarding the changes we have made to Municipal Court through the years. There was discussion regarding the funding, we will have to fund the ordinance changes. Roland stated that when we change we will then have to pay attorney fees by the hour so this does not necessarily mean there is a savings to the city. It is unpredictable on these type of cases.

Councilor Coffin made and Councilor Karvoski seconded the motion to proceed with disbanding Municipal Court effective June 30, 2014. Motion passed with 5 in favor and Councilor Miller opposing.

Councilor Karvoski made and Councilor Coffin seconded the motion to move to direct the Police Dept. to begin all violations excluding municipal ordinances to Circuit court beginning January 1, 2014. Motion passed unanimously.

Council Karvoski made and Councilor Parks seconded the motion to direct the City Attorney to begin preparing civil penalty ordinances and hearing procedures, and bring back to the Council for approval. Motion passed unanimously.

The Committee will discuss this issue with Paige. Roland will prepare the letter for the Mayor's signature.

WATER PROJECT

Councilor Karvoski made and Councilor Miller seconded the motion directing the Mayor to sign the loan applications. Motion passed with 5 in favor and Councilor Coffin opposing.

NEW BUSINESS

Resolution. 572 Reclassification of expenditures in the Historic Preservation Fund for the purposes is expending the Facade Grants. Councilor Coffin made and Councilor Miller seconded the motion which passed unanimously by Roll Call Vote.

Eagle Cap Extreme –Mayor Shaw read a request from Eagle Cap Extreme request streets closures on Main Street by the Courthouse on January 22, 2014 for the dog vet checks. Councilor Karvoski made and Councilor Parks seconded the motion which passed unanimously to approve the street closure.

The Council received written staff reports

BARGAINING

Roland brought up that bargaining contracts are due. The Bargaining Committee needs to meet to discuss what the city position will be for the upcoming contract period. Roland recommended that we do a salary survey. The City Council asked Michele to begin doing the salary survey.

Mayor Shaw wished everyone a Very Merry Christmas. Meeting was adjourned.
